GENERAL TERMS AND CONDITIONS OF INTERNET SALES

The company Alix D Reynis, SARL with a capital of 14 320 €, whose head office is located at 42, rue Chateaudun, 94200, Ivry Sur Seine - FRANCE, wishes to formalise, by means of these general terms and conditions of sale, the conditions of sale of its products applicable to the orders placed by the customer on its website: www.alixdreynis.com.


Preamble


Alix D Reynis manufactures and markets worldwide, porcelain objects and vermeil jewellery, sold under the brand "Alix D Reynis".


The list of products offered for sale online by Alix D Reynis can be consulted on this site.


The customer and Alix D Reynis agree that their commercial relationship shall be governed exclusively by these general terms and conditions of sale.


Alix D Reynis reserves the right to modify its general terms and conditions of sale at any time by publishing a new version on the site.


 The general conditions of sale applicable to each order are those in force at the time of their validation on the site.



Article 1. - Object


The purpose of these general terms and conditions of sale is to define the rights and obligations of Alix D Reynis and the customer in the context of the online sale of products offered on this website.  

     Article 2. – General provisions


These general terms and conditions of sale apply to all sales of products made via the vendor's website and form an integral part of the contract between the customer and the vendor. They can be consulted on the vendor's website: www.alixdreynis.com.
The vendor ensures that their acceptance is unequivocal and unreserved by means of a check box and a validation click for each transaction.
The Customer thus declares to have read and understood all of these general terms and conditions of sale and, where applicable, the specific terms and conditions of sale relating to a product or service, and to accept them unreservedly and without reservation. 
The Customer acknowledges having had access to the advice and information necessary to ensure the suitability of the offer to its needs. The Customer declares that he/she has the legal capacity to place orders under French law or to represent the natural person or legal entity on whose behalf he/she is acting. Unless proven otherwise, the information recorded by the seller constitutes proof of all elements of the transaction.
These general terms and conditions of sale apply to orders placed for delivery in France or abroad.
 
 

Article 3. - Entry into force and duration


The present general conditions of sale are applicable to the parties on the date of validation of the order.
The present general conditions of sale are applicable for the duration necessary for the delivery of the products, until the expiry of the guarantees and obligations due by Alix D Reynis.

Article 4. - Ordering products and services and steps to complete the online sale

In order to place an order, the Customer must complete the following steps 1. enter the address of the website or access the website via a link.
2. Follow the instructions given on the Site and in particular the instructions for opening a customer account. 3.
4. Fill in the order form. 
5. Check the elements of the order and, if necessary, identify and correct errors.
6. 6. Read and accept Alix D Reynis' general terms and conditions of sale, then validate the order and the total amount to be paid. 7. follow the instructions of the online payment server to pay the total amount indicated. 
If the server is not available, the customer will be able to pay after final validation of the order on the website.
In return, the Customer will receive an e-mail confirming the payment of the order, together with an acknowledgement of receipt. The products ordered will be delivered to the address indicated by the Customer. 
In order to complete the order, and in accordance with article 1316-1 of the French Civil Code, the Customer undertakes to provide all elements of identity authenticity.
 All orders placed on the Site are intended exclusively for the personal use of the Customer and the Customer or the recipient of the Products shall refrain from any partial or total resale of the Products ordered.
The Customer undertakes to comply with the present general terms and conditions of sale during the various stages of the order described above.
 In accordance with article L. 122-1 of the French Consumer Code, Alix D Reynis reserves the right to refuse any order that appears to be abnormal (in particular with regard to the quantities ordered), made in bad faith or for any other reason of inadmissibility, in particular if there is a dispute with the customer concerning the payment of a previous order.  

Article 5. - Product prices and conditions

The price of the products sold on the Site is indicated respectively by article and by reference, except for typographical errors. These prices take into account the V.A.T. applicable on the day of the order but do not include the delivery charges which will be invoiced in addition as specified to the Customer during the validation of his order.
For all orders shipped outside the European Union and/or French overseas departments and territories, the price is automatically calculated excluding tax on the invoice. Customs duties or other local taxes or import duties or state taxes may be required in certain cases. These rights and sums are not the responsibility of the seller. They will be charged to the customer and are the responsibility of the customer. The seller invites the customer to inquire about these aspects with the corresponding local authorities.
At the time of the validation of the order, the price to be paid corresponds to the total amount of the order.
The product offers and their prices are valid as long as they are accessible on the Site within the limits of available stocks.
 In this respect, information on the availability of products may be provided to the Customer at the time of placing the order. Errors or modifications may exceptionally occur, particularly in the case of simultaneous orders of the same item by several customers. In the event that an item is unavailable after the Customer has confirmed the order, Alix D Reynis will notify the Customer by e-mail as soon as possible, offering the Customer the option to order another item presented on the Site as a replacement, or to cancel the order. If the customer chooses to cancel the order, the refund will be made within 30 days of payment if the customer's bank account has been debited. 
 Alix D Reynis reserves the right to modify at any time and without notice the lists of products and/or prices offered on the site, it being understood that those in force at the time of the order will be those accepted by the Customer by validating the latter.
 The customer is duly informed that the illustrations, colours, photographs and descriptions of the products are only indicative and do not enter the contractual field. Alix D Reynis cannot be held responsible for any errors or inaccuracies.
 The telecommunication costs associated with accessing the site are the sole responsibility of the customer.
 The validity period of the product offers and prices is determined when the site is updated.
 


Article 6. - Terms of payment


Payment is due immediately at the time of ordering.
The customer pays by credit card. Payment of the amount of the order shall be made exclusively by one of the following means of payment VISA or MASTERCARD.
Cheques and bank transfers are not accepted.
The transaction will be charged to the customer's credit card at the time of dispatch and, after verification of the card data, upon receipt of the debit authorisation from the credit card issuer used by the customer.
When the payment is initiated by the customer, the transaction is debited immediately after verification of this information. In accordance with article L.132-2 of the French Monetary and Financial Code, the commitment to pay by card is irrevocable as soon as it is activated.
By providing his credit card details, the customer authorises Alix D Reynis to debit his credit card with the amount corresponding to the total amount of the order.
 The Customer therefore authorises his bank in advance to debit his account on the basis of the records or statements transmitted via the payment module, even in the absence of invoices signed by the credit card holder. 
To this end, the Customer certifies that he is the holder of the bank card to be debited and that the name on the card is his. The Customer shall communicate the sixteen digits and the expiry date of his bank card and, if necessary, the numbers of the visual cryptogram.
In the event that the total amount to be paid cannot be debited, the Customer will be asked to restart the payment procedure. If the impossibility of debiting is confirmed, the online sale will be immediately dissolved by law and the order will be cancelled.
The occurrence of an unpaid amount due to fraudulent use of a bank card will result in the registration of the details relating to this unpaid amount in a payment incident file set up by a third party organisation. An irregular declaration or anomaly may also be the subject of a dispute. 


Article 7. - Delivery of the Order


Products will be delivered to the delivery address provided at the time of ordering. The customer is solely responsible for any failure to deliver due to a lack of or error in the geographical information.
The amount of delivery costs depends on the amount and nature of the order. In any case, the amount of these costs will be indicated to the Customer before validation of the order.
Subject to the availability of the selected products, the delivery method will be indicated to the Customer during the validation and payment of the order. The delivery time depends on the final delivery method.
Delivery times are calculated from the date of confirmation of the order by Alix D Reynis according to the average preparation and delivery times of the order. 
Delivery times are given as an indication and are considered to have been met by Alix D Reynis if the first presentation of the order at the address indicated by the customer has taken place within the time indicated to the customer.
In the event of late delivery, the customer has the right to cancel the contract in accordance with the provisions of article L138-2 of the Consumer Code. The seller will then refund the product in accordance with the provisions of article L138-3 of the Consumer Code. The vendor will provide a contact point, indicated in the order confirmation email, which will allow the order to be followed up. The Seller reminds the Customer that the risk of loss or damage to the Products is transferred to the Customer when the Customer takes physical possession of the Products. It is therefore the customer's responsibility to notify the carrier of any reservations regarding the product delivered. The Customer is obliged to check the condition of the packaging and the goods on delivery.
It is up to the Customer to make the reservations and complaints that he/she deems necessary, even to refuse the parcel, in particular if the parcel is obviously damaged on delivery, and this before it is opened (for example, if a noise of breakage is heard inside). These reservations and detailed complaints must be notified to the deliverer and also sent to the carrier by registered letter with advice of delivery within three working days, not including public holidays, from the date of delivery of the products. In all cases, it is important to specify the reasons, knowing that a reservation of the type "subject to opening the package" has no value, while a reservation of the type "very damaged package, scratched on the top left, taped" is an accepted reservation.
The customer must also send a copy of this letter to Alix D Reynis. Failure to lodge a complaint within the aforementioned time limit shall result in the loss of any right of action against the carrier pursuant to Article L. 133-3 of the French Commercial Code.
If the package is in good condition, but the product is damaged on opening, it is up to the customer to return it to us for examination in accordance with the conditions below, indicating on the return slip the reason for the complaint. The Customer must ensure that the products delivered to him/her correspond to the order. In the event that the nature or quality of the Products does not correspond to the specifications on the packing slip, the Customer must return the Products, complete and in their original packaging, to the following address within seven (7) calendar days of receipt of the order by the Customer, accompanied by the return form: Alix D Reynis 14 RUE COMMINES 75003 PARIS. It is up to the Customer to provide proof of the return, which means that the goods must be returned by CHRONOPOST or by any other means indicating a specific date, the costs and risks of the return being borne by the Customer. 

Article 8. - Right of withdrawal


In accordance with article L.121-20 of the Consumer Code, "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify his reasons or pay penalties, except, where applicable, the cost of returning the goods. "The period referred to in the previous paragraph shall run from the date of receipt of the goods or acceptance of the offer for services. The right of withdrawal may be exercised by contacting the vendor by e-mail at client@alixdreynis.com. If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased will be refunded, the cost of returning the product(s) remaining at the expense of the customer.
The products must be returned in their original condition and complete (packaging, labels, etc.) so that they can be resold as new.
They must, if possible, be accompanied by a copy of the proof of purchase and should be sent to

Article 9. – Claims

Article 10. – Guarantees 


In accordance with the law, the vendor provides a guarantee of conformity and a guarantee for hidden defects in its products. The vendor will reimburse the customer for products that are obviously defective or do not correspond to the order placed. The request for reimbursement must be sent by e-mail to the following address: bonjour@alixdreynis.com.
The articles returned by the customer incomplete, damaged, deteriorated or soiled will not be exchanged and will be returned to him immediately or by post as soon as possible. 

Article 11. - Intellectual property rights


The trademarks, domain names, products, images, videos, texts or, more generally, any information subject to intellectual property rights are and remain the exclusive property of the Seller. No transfer of intellectual property rights is made by these general terms and conditions. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.
 


Article 12. – Protection of personal data


In accordance with the Data Protection Act of 6 January 1978, you have the right to access, correct, oppose and withdraw your personal data. 
By accepting these general conditions of sale, you consent to the collection and use of this data for the purposes of the present contract. By entering your e-mail address on our website, you will receive e-mails containing information and promotional offers on products published by the vendor. You may unsubscribe at any time. You can unsubscribe at any time by clicking on the link at the bottom of our emails or by contacting us by registered letter with return receipt. 
We monitor the traffic on our website using tools such as Google Analytics. 
 


Article 13. - Force Majeure


The performance by Alix D Reynis of its obligations under the terms of these general terms and conditions of sale will be suspended in the event of the occurrence of any fortuitous event or force majeure that would prevent or delay its performance.
 


Article 14. - Invalidity and modification of the contract
 

If any provision of this Agreement is held to be invalid, such invalidity shall not affect the validity of the remaining provisions, which shall remain in force between the parties. Any amendment to the contract shall only be valid if agreed upon in writing and signed by the parties.
 


Article 15. Limitation of liability


Alix D Reynis cannot be held responsible for any damage resulting from the use of the Internet network, such as loss of data, intrusion, computer viruses, connection failure, interruption of the Internet network or other problems beyond its control.
Alix D Reynis reserves the right to suspend the operation of the site at any time.

Article 16. - Non-waiver


The fact that AlixD Reynis does not make use of any of the obligations mentioned in these general terms and conditions cannot be interpreted as a waiver of the obligation in question for the future.

Article 17. – Applicable law


These general conditions of sale are governed by French law.
Any dispute arising from the establishment, interpretation or execution of these general terms and conditions of sale shall be subject to the exclusive jurisdiction of the French courts, notwithstanding the existence of multiple defendants or third parties.

The Customer therefore declares to have read and understood the entirety of these General Terms and Conditions of Sale and, where applicable, the Specific Terms and Conditions of Sale relating to a product or service, in order to accept them in full and without reservation.
